We value your privacy


Like with many businesses, YELLOW holds and processes a wide range of information about its clients and other persons who may be interested in YELLOW’s services. We collect certain minimum identification information from each client who goes through the home buying or selling process with YELLOW and take measures to verify the identity of each client.

We may update this privacy notice from time to time, and will post any revised notice on this webpage. Where appropriate we may notify you by email or by a notice on our website that our privacy notice has changed but we recommend that you check this page regularly. Any changes will be immediately effective on posting.


Required Client Information

Prior to listing or visiting a home, we will collect the following information:

  • BUYERS: client name
  • SELLERS: client name and residential street address

We will ensure that we have a reasonable belief that we know the true identity of our clients by using procedures to verify and document the accuracy of the information we get about our clients. We will analyze the information we obtain to determine whether the information is sufficient to form a reasonable belief that we know the true identity of the client.


Clients Who Refuse to Provide Information

If a potential or existing client either refuses to provide the information described above when requested, or appears to have intentionally provided misleading information, our firm will not permit use of our services.


Verifying Information

We will verify client identity through documentary means, non-documentary means, or both. We will use documents to verify client identity when appropriate documents are available. In light of the increased instances of identity fraud, we will supplement the use of documentary evidence by using the non-documentary means described below whenever necessary.

In verifying the information, we will consider whether the identifying information that we receive, such as the client’s name, street address, zip code, and telephone number (if provided), allow us to determine that we have a reasonable belief that we know the true identity of the client (e.g., whether the information is logical or contains inconsistencies).

Appropriate documents for verifying the identity of clients include the following:

  • FOR BUYERS: An unexpired government-issued identification bearing a photograph, such as a driver’s license, passport, or military id.
  • FOR SELLERS: An unexpired government-issued identification bearing a photograph and residence location, such as a driver’s license or passport.

    AND

    Proof of residential address. This can be a bank statement or utility bill, for example, dated within the last three months.

FOR SELLERS: We will use the following non-documentary methods of verifying property ownership:

  • Independently verifying the client’s property ownership through government property records


Lack of Verification

When we cannot form a reasonable belief that we know the true identity of a client, we will not permit use of our services.


Recordkeeping

We will document our verification, including all identifying information provided by a client, the methods used and results of verification, and the resolution of any discrepancies identified in the verification process. We will keep records containing a description of any document that we relied on to verify a client’s identity, noting the type of document, any identification number contained in the document, the place of issuance, and if any, the date of issuance and expiration date. With respect to non-documentary verification, we will retain documents that describe the methods and the results of any measures we took to verify the identity of a client. We will also keep records containing a description of the resolution of each substantive discrepancy discovered when verifying the identifying information obtained.

In accordance with Florida Real Estate Statutes, we will retain records of all identification information for five years after the transaction has been completed or the conclusion of the use of our services; we will retain records made about verification of the client's identity for five years after the record is made.

Brokerage business records

Each broker shall preserve at least one legible copy of all books, accounts, and records pertaining to her or his real estate brokerage business for at least 5 years from the date of receipt of any money, fund, deposit, check, or draft entrusted to the broker or, in the event no funds are entrusted to the broker, for at least 5 years from the date of execution by any party of any listing agreement, offer to purchase, rental property management agreement, rental or lease agreement, or any other written or verbal agreement which engages the services of the broker.


Location of Stored Information

Any physical documents will be held in our on-site file storage facility. All electronic records will be held on a private, password-protected, and encrypted cloud storage location.

As effective as modern security practices are, we cannot guarantee the complete security of personal data held in our systems, nor that that information you supply through the internet or any computer network is entirely safe from unauthorized intrusion, access or manipulation during transmission. Any transmission is at your own risk. We will not be liable for any resulting misuse of your personal data.


Privacy Considerations & Proper Document Destruction

All information gathered during the use of our services will only be used by YELLOW.

We collect data about your computer when you visit our website, which includes your internet address, your operating system, and browser type. We use this information for our internal system administration, to help diagnose problems with our servers, to administer our website, and monitor and improve the user experience. We do not track your computer using cookies or other internet-tracking services.

We do not transfer your personal data to organizations who wish to use it for their own marketing promotions or other purposes.

Your personal data will only be shared with other organizations where it is necessary to enable us to provide you with the services you have requested (for example: we may transfer your information to your lender or title service). Where we do so it will be on the basis that these organizations are required to keep the information confidential and secure, and they will only use the information to carry out the instructed services.

At the completion of the required retention period, paper documents will be shredded and electronic records will be electronically shredded and wiped from the secure server.
